Signal Snowboards, Inc. (“Signal” or “we”) has developed this Privacy Policy to help you understand how we use and/or disclose information that you provide to us and information that we collect from your device (e.g. your computer, phone, or other mobile device) (“Device”) while you access, browse, and use our official website, located at https://signalsnowboards.com  (the “Website”).

By using the Website, you agree to this Privacy Policy and consent to the collection and use of your information as set forth in this Privacy Policy. You also agree to Signal’s Terms of Use found below in the Terms of Use section, which are incorporated into this Privacy Policy. 

  1. WHAT TYPE OF INFORMATION DOES SIGNAL COLLECT?

When you access, browse, or use the Website, the type of information that we collect from you can be broken down into the following categories: the information that you provide to us directly, information that we collect automatically while you use the Website, and information collected from third parties.

  1. Information You Provide to Us Directly. When you use the Website, there is certain information you may provide to us directly:
    1. To Create an Account: To access some of the features of the Website, you will need to create an account (“Account”). Unless you choose to create an Account by signing into to a Third-Party Platform (as defined below), you will need to provide us with your first and last name, your email address, and a password. In addition, if you would like to purchase a snowboard or subscribe to the MOD Program, you will need to provide us with your mailing address. Any billing information that you provide is stored by our third-party payment processors, PayPal, Stripe, Shopify Pay, Amazon Pay, and Recharge, and we may add or remove payment processors at a later time. The payment processor's use of your information is subject to that payment processor's own privacy policy.  
    2. Customer Support: If you contact us via email or chat with us directly on the Website, we will collect and store the contact information you provide to us (e.g. your email address and your name) so that we can respond to your requests.
    3. Product Reviews and Other Public Comments: Throughout the Website, you have the option to post public product reviews and other comments. These reviews and comments will be seen by others who visit the Website, and we may access in real-time, record, or store archives of these public comments on our servers to protect Signal's interests and to personalize your experience on the Website.
  2. Information that We Collect Automatically. When you use the Website, there is certain information that we will automatically collect from the Device that you are using to visit the Website including, without limitation, identifiers such as your IP address and other location information, and "Log Information" such as your browser type, operating system, referral and exit pages, and your access times. We use cookies and log files to automatically collect this information. For more information on our use of cookies, please see below in the Cookies Section 4.
  3. Information Collected from Third Parties. You may create an Account with us by logging into your account on a third-party platform (e.g Facebook, Google, or Amazon) (“Third-Party Platform”). Depending on your privacy settings, when you connect your Account with a Third-Party Platform we may collect certain information from the Third-Party Platform, including, but not limited to, your name and location.
  1. HOW WE USE YOUR INFORMATION.

We use your information in the following ways:

  • To operate, improve, and maintain the Website;
  • To personalize your experience on the Website;
  • To fulfill your orders and respond to your customer service requests;
  • To send you newsletters, information, or updates about Signal (for more information about newsletters and other marketing communications, please see our section Newsletters and Other Marketing Communications (section 5.)
  • To respond to your questions about Signal; 
  • To understand how you interact with the Website; 
  • To enforce our Terms of Use (below) and to comply with our legal obligations.  
  1. THIRD PARTIES WE MAY SHARE YOUR INFORMATION WITH.

Signal does not sell your information to third parties without your prior consent, and will only share or disclose your information as follows:

  1. Third-Party Service Providers. We engage third parties to perform services on our behalf, such as services for payment processing, customer service, email delivery, hosting, and analyzing data. We will share or allow these third-party service providers to access your information, including, without limitation, Log Information and IP addresses, so that they can provide us with the services. We contractually require all third-party service providers to only use your information in connection with the requested services and to treat your information as confidential information.
  1. Business Transfers. As we continue to develop our business, we may reorganize as a business entity, acquire entities, subsidiaries, or business units, or enter into joint ventures with third-parties. In any of these types of transactions, any information you provide may be one of the transferred business assets (subject to any pre-existing privacy notice unless you consent otherwise). In the event that all or substantially all of our assets are acquired or we merge with a third-party, your information will likely be one of the transferred assets. You understand and agree that we reserve the right to transfer any information collected from you in the case of any such transfer. In such event, we will use reasonable efforts to notify you before information about you is transferred and becomes subject to a different privacy policy.

We may also disclose your information to defend against legal claims when we believe that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request. We may share your information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, and situations involving potential threats to the physical safety of any person, violations of our Terms of Use, or as otherwise required by law.

  1. What are Cookies? A cookie is a small text file that is stored on your web browser and used to recognize you while you use the Signal Services. Cookies can either be session cookies, which are cookies that expire automatically when you close your web browser, or persistent cookies, which are cookies that persist indefinitely or for a set period of time. Cookies can also be placed by the website that you are visiting, which are called “first-party cookies,” and or they can be placed by other companies, which are called “third-party cookies.”
  2. What Do We Use Cookies For? Signal uses first-party cookies to identify users, analyze their use of the Website, such as which links the user clicked on the Website and the amount of time spent on the Website, and to show users advertising that they would find the most interesting. Signal also uses cookies to remember your preferences, such as staying logged into your Account and remembering the items in your shopping cart.
  3. What Third Parties Use Cookies on the Website? As written above, Signal uses third-party service providers to perform services on our behalf, such as analytics. Analytics companies, such as Google Analytics, will use cookies to generate statistics about Website traffic. 
  4. What Are My Cookie Options? If you do not want to receive cookies while browsing the Website, you can set your browser to refuse the cookies. You may also delete cookies after visiting the Website. To refuse or delete cookies, please refer to the specific instructions provided by your web browser. Please also note that if you choose to refuse certain cookies from the Website, some parts of the Website may not be available to you.
  5. What Other Tracking Technologies Does Signal Use? We use other technologies such as local shared objects (LSOs or flash cookies), web beacons, and pixel tags to identify you or your Device, save your preferences, and to track your events on the Website. 
  1. NEWSLETTERS AND OTHER SIGNAL MARKETING COMMUNICATIONS. 

We may use your information to send you newsletters and other marketing communications about Signal. If you wish to unsubscribe from a mailing list, you can click on the “unsubscribe” link at the bottom of the email and you will stop receiving marketing communications. Please allow up to twenty-four hours before you stop receiving marking communications. Please also note that you may continue to receive emails unrelated to marketing. 

  1. SOCIAL MEDIA FEATURES.

The Website includes integrated social media features, such as the Facebook “like” button and the Twitter “share” button. Depending on your privacy settings on the social media platform, these features may collect information such as your name and location information. Social media features are hosted by that social media network and your interactions with these features are governed by the privacy policy and terms of use of that social media network.

  1. THIRD PARTIES AND THEIR PRIVACY POLICIES.

Throughout the Website, you will see links to third-party websites or applications that are controlled by companies other than Signal. If you click on these links and visit the third-party websites or applications, we are not responsible for the content or services provided by these third parties. You are subject to the terms of use and privacy policies of the third parties and we encourage you to review them.

  1. SECURITY.

The security of your information is important to Signal. We follow generally accepted industry standards to protect the information submitted to Signal, both during transmission and once it is received. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security. While no security system is completely secure, we and our third-party partners and vendors take appropriate security measures to protect against unauthorized access or disclosure of the information we collect. For Signal, this includes, but is not limited to, ensuring that all Information is disclosed only on a "need to know" basis and ensuring that all information collected by Signal is done so via secured connections and protected and encrypted industrial grade security software to guard against unauthorized access.

  1. INTERNATIONAL TRANSFERS OF YOUR INFORMATION.

As an organization operating through the internet, we may transfer your information across international borders to third parties acting on its behalf, or for the purposes of processing or storing your information under this Privacy Policy. By providing any information to us, you consent to the transfer, processing, access, and storage of such information outside of your country of residence, where data protection standards may be different.

  1. ACCESSING, MANAGING, AND UPDATING YOUR INFORMATION.

  1. MINORS.

The Website is not directed to children under the age of 13 and we do not knowingly collect information from children under the age of 13. If we learn that we have received any type of information from a child under the age of 13, we will delete such information. Please contact us at frontdesk@signalsnowboards.com if you believe we have collected information from a child.

  1. CHANGES TO THIS PRIVACY POLICY.

We may update this Privacy Policy from time to time. If we make any material changes as to how we collect, use, or disclose your information, we will notify you via email if we have your email address on record, or via a notice on the Website.
